BREAKING YOUR RENTAL AGREEMENT / LEASE
Woodstock Properties, Inc. understands that Tenants must sometimes break their lease for unexpected reasons and we are here to help you through this transition. In fact, once you notify us in writing, we will actively work with you to get the property rented to another qualified tenant ASAP. Once a new, qualified tenant begins rental payments, your Rental Agreement terminates and you will be released from your Rental Agreement obligations.
The following is what you are required to pay when breaking your Rental Agreement:
Breaking Lease Fee
The Breaking Lease Fee is $500 or 25% of your monthly rent, whichever is greater. This fee is due from anyone who does not fulfill the term of their Rental Agreement, except where the “Military Tenant Clause” applies.
Advertising costs of $150 must be paid by tenant in order for Woodstock Properties, Inc. to put forth all efforts in getting the property rented by another qualified party.
Other than cable, ALL utilities must remain turned on until the end of the Rental Agreement or until a new tenant commences rental payments, whichever occurs first. UTILITIES MUST REMAIN ON FOR YOUR CHECK-OUT! Call your respective Utility Company(s) ASAP and schedule in advance to have your utility(s) terminate the day AFTER your Check-Out appointment. We will, in turn, have the utilities transferred into the name of Woodstock Properties, Inc. beginning the day after your Check-Out appointment. If utilities do not remain on as required for your Check-Out appointment, you will be assessed the HECO “start-up” fee plus a service fee. Please understand, your obligation to pay for these utilities continues until the termination of your Rental Agreement or until a new tenant commences rental payments, whichever occurs first. If your Check-Out date occurs prior to the termination of your Rental Agreement, Woodstock Properties, Inc. will subsequently be receiving the utilities bills as of the date we place them in our name and the remaining financial obligation for these utilities will be itemized and deducted from your Security Deposit. Call the office if you are unsure about when to have your utilities turned off.
Board of Water Supply
Landlord will charge whichever is greater, a service fee of $100 or 25% of all costs for carpet cleaning, unit cleaning, pest treatment and repairs (which are not the result of normal wear and tear) that are coordinated by Landlord as a result of Tenant’s failure to coordinate these services. This service fee will be in addition to the charge to Tenant for the actual costs for the aforementioned cleaning, pest treatment and repairs.
Monthly rent continues to be due on the first day of each month until the end of your Rental Agreement or until a new tenant commences rental payments, whichever occurs first. You may not use your Security Deposit to pay rent.
Tenant shall be liable for $25 per showing when a Woodstock Properties, Inc. staff member shows the property. There is no showing fee whenever exiting Tenant shows the property.
If your Rental Agreement states you are responsible for yard/garden care then you are still required to maintain the yard/garden until the end of your Rental Agreement or until a new tenant commences rental payments, whichever occurs first. This includes but is not limited to, water, weeding, mowing and any other Tenant responsibilities as outlined in the Rental Agreement.
NOTE: The sooner you notify Woodstock Properties, Inc. of your “Intent to Terminate Your Rental Agreement”, the quicker we can find a replacement Tenant, thus reducing your expenses.
